2002-02-21: MA legalizes sex

The MA Supreme Judicial Court legalized (consensual, non-public) sex last week: http://www.glad.org/press48-2-21-02.html

(previously, if I recall correctly, the only clearly legal sex in MA was a married couple in missionary position)

How frighteningly broad! This is a good ruling.

Yup. I titled this "MA legalizes sex" for a reason - almost all sex was effectively illegal in this state.

I suppose that "the abominable and despicable crime against nature, either with mankind or with a beast" is still illegal, though. Ah well. At least I can feel a little prouder of my home state's politics.

Thats not entirely clear. Further, the legal affect of this ruling is also not entirely clear. As this was not a criminal case, it establishes civil, but not truly criminal precedence. Although, as it appears that the civil authorities are barred from bringing a case, this distinction may be irrelevant.

On the other hand, if the sodomy law were used, with this precedence, hit could be found unenforcably vague, or just unenforcable as well.
